Identify drivers who operate commercial motor vehicles requiring a commercial driver’s license and perform safety-sensitive functions under FMCSA rules. Keep a current covered-driver roster and promptly add or remove drivers as employment and duties change.

What should happen before a driver performs safety-sensitive work?

  • Complete the required pre-employment drug test and receive the appropriate negative result
  • Complete required FMCSA Clearinghouse queries
  • Address applicable prior-employer or other DOT-agency testing-history requirements

What must be maintained during employment?

Maintain a scientifically valid random-selection program, issue testing instructions without advance notice, and spread selections through the year. Train supervisors who will make reasonable-suspicion determinations. Use the FMCSA post-accident criteria rather than automatically testing after every incident. Respond promptly to verified violations and keep required records secure and retrievable.

What should an employer review before an audit?

Review the driver roster, negative pre-employment results, Clearinghouse documentation, random-selection records, collection forms, annual summaries where applicable, supervisor-training records, written policy, result files, and documentation of corrective action. Owner-operators who are not leased to a motor carrier have additional consortium requirements.
